ANNO REGNI VICTORIÆ BRITANNIARUM REGINÆ TRICESIMO SEXTO.
AT the General Assembly of the Province of New Bruns-
wick begun and holden at Fredericton on the sixteenth day
of February Anno Domini one thousand eight hundred and
seventy one, in the thirty fourth year of the Reign of Our
Sovereign Lady Victoria, by the Grace of God, of the United
Kingdom of Great Britain and Ireland, Queen, Defender of
the Faith, and from thence continued, by several Proclama-
tions [sic], to the twenty seventh day of February, one thousand
eight hundred and seventy three, being the fourth Session of
the Twenty second General Assembly convened in the said
Province.

CAP. LXXV.

An Act to erect a part of the Parish of Saint Stephen, in the County
of Charlotte, into a separate Town or Parish.


Sec.
1 Bounds and name of new Parish.
2 New Parish to have same rights,
   &c., as other Parishes.
3 Act not to interfere with previous
   assessments.
Sec.
4 Parish Officers, how elected or
   appointed.
5 Parish Clerk, by whom appointed.
6 Polling place, where situate.
7 When old Revisors' List may be
   used.
Passed 14th April, 1873.


     BE it enacted by the Lieutenant Governor, Legislative
Council, and Assembly, as follows :-

    1. From and after the passing of this Act, all that part of
the Parish of Saint Stephen in the County of Charlotte,
lying and being within the following boundaries, to wit :
Commencing at a point in the centre of the channel of the
Saint Croix River, opposite the mouth of Porter's Mill
Stream, so called, in the said Parish ; thence following the
centre of the channel of the Saint Croix River down stream
around Oak Point, so called, to Oak Point Bay, and up the
centre of the channel thereof and of Pagan's Cove to the
Parish line between the Parishes of Saint David and Saint
Stephen ; thence northwesterly along the said boundary line
till it strikes the Bay Road, so called ; and thence westerly
along the said Road to Porter's Mill Stream, and thence
following the course of the said Stream to the place of begin-
ning, shall be and the same is hereby erected into a separate
Town or Parish, to be known as the Parish of "Dufferin."

    2. The said Town of Parish of Dufferin shall have the
same privileges and be subject to the same laws and regu-
lations as extend to or govern the other Parishes of the said
County.

    3. This Act shall not interfere with or prevent the re-
covery of any assessment which may have been previously
made or ordered, or with any fines, penalties or moneys
which may have accrued or become due, or with the dis-
charge of the duties of any officer who may have been ap-
pointed for the term of his appointment ; but every such
officer shall discharge his duty until the expiration of his
term of office, in the same manner as if this Act had not
been passed, and nothing in this Act contained shall be
construed to relieve either section of the said Parish hereby
divided, from its respective existing liabilities.

    4. The several Parish officers for the said Town or Parish
of Dufferin, shall be elected or appointed in the manner
provided for by Title viii, of the Revised Statutes, 'Of the
local government of Counties, Towns, and Parishes,' and
shall in all respects be subject to and come within the pro-
visions of the said recited Title.

    5. Any two Justices of the Peace for the said County
shall and may appoint a fit and proper person residing within
the limits of the said Town or Parish of Dufferin, as Clerk
for the election of Parish officers, agreeably to the provisions
of the said recited Title, for the first year after this Act
coming into operation.

    6. The Polling place for the said Parish of Dufferin, for
the election of Members to serve in the General Assembly,
shall be and the same is hereby declared to be at or near the
School house at the Ledge, and the Polling place for the
Parish of Saint Stephen shall be the same as now established
by law.

    7. If any Election of Members to serve in the General
Assembly for the County of Charlotte shall be held before
a new Revisors' list shall be made out for the said Parishes
of Saint Stephen and Dufferin, the Sheriff shall from the
present list select the electors who reside in the Parish of
Dufferin hereby created, which shall be the list for such last
mentioned Parish, who are to vote at the polling place es-
tablished by this Act for the said Parish of Dufferin ; all
other electors who are entitled to vote in the Parish of Saint
Stephen, shall vote at the polling place heretofore established
for the said Parish of Saint Stephen.
