Excerpts from General Safety Rules:

Safety shall be regarded by everyone as a prime consideration in the successful performance of their duties. Management is specifically responsible for the development and implementation of safe practices and procedures.

Employees have the responsibility to perform their duties in a manner that will not jeopardize the safety of customers or adversely affect their own health, safety or physical well being or that of their fellow workers.

Via Employees are required to abide by applicable federal, provincial and municipal laws and regulations.

 

G.O.I. Section 4.4 item 6 (f) Hours of Work Operating Employees Canada

The order is directed to CN and VIA Rail and it will be the joint responsibility of management and employees to ensure that they are in compliance with the order and do not accept a call for duty in violation hereof.

 

MacKenzie Award Article E-3 ( c ) and E-12

E-3 ( c ) General Holiday pay is paid at straight time, over and above the guarantee and is not calculated in the accumulation towards 160 hours. In addition, time worked on the actual General Holiday is paid at time and one-half, and those hours worked are calculated in the accumulation towards 160 hours.

E-12 Regularly assigned locomotive engineers who book rest at their home terminal, which results in their missing their assignment, will have their guarantee reduced by the hours of the assignment missed, unless the relieving locomotive engineer was required to report for duty within ten hours from the time the regularly assigned locomotive engineer booked rest.

 

1.1 Agreement Article 76.5 Employees required to work on General Holiday

An employee who commences a shift or tour of duty between 0001 and 2359 hours on a general holiday shall qualify for a holiday with pay providing such employee has completed 30 days of continuous
employee relationship. An employee qualified under this paragraph shall,

(a) be paid, in addition to the amount provided in paragraph 76.6 wages for work performed by him at a rate equal to one and one-half times his regular rate of pay. (When more than one shift or tour of duty is worked by an employee on a general holiday the provisions of this clause shall apply to the first shift or tour of duty).
