About the Program:
Fact-finding is an informative dispute resolution process that can be used to break
negotiating impasses, give parties objective information for decision-making, or narrow
the scope of disputes. The workshop includes didactic presentation,
demonstration, role playing, and group work. The design allows the
participants to gain valuable checklists and precedents, examine different models of
fact-finding, learn the stages of fact-finding, learn what a fact-finder's terms of
reference should contain, and write a fact-finder's report.
About the Facilitators

Genevieve A. Chornenki, LL.M., C.Med., F.C.I.Arb.
Genevieve Chornenki is co-author of Bypass Court; A Dispute Resolution Handbook (Butterworths), and contributing
author to the Alternative Dispute Resolution Practice Manual (CCH) and The Accountant's Guide to Litigation Management
(Carswells). Ms. Chornenki is knowledgeable about a wide range of dispute management processes, including
the elements of fact-finding. She practices, consults, teaches, and writes in the field.
Judith H. Clarkson, R.N., B.A., LL.B.
Judith Clarkson has an extensive background in health care and public utilities, and is experienced in human resources,
labour relations and organizational issues. With professional designations in both law and nursing, she
currently practices, teaches, and consults about dispute prevention, management, and resolution in a wide range of
public and private contexts. She is experienced with fact-finding as both a party and fact-finder in a
range of situations.
Both Genevieve Chornenki and Judith Clarkson are principals of Mediated Solutions Incorporated, a company that
prevents, manages, and resolves disputes for individuals, businesses, and public and private organizations.
Both teach at the University of Toronto.
